Article 1: Conclusion of Sales Contracts

The confirmation and submission of the order by the customer (for “Customer” it means the user of the site mascotte-costumi.com who accesses the e-commerce checkout), according to the instructions that will appear from time to time on the web pages, implies the acknowledgment and full acceptance of these general sales conditions by the Customer. The sales contract between mascotte-costumi.com and the Customer is considered finalized with the acceptance of the order by mascotte-costumi.com.
If the Customer is a consumer (a natural person who purchases goods for purposes not related to their professional activity, or makes the purchase without indicating a VAT reference in the order form) once the online purchase procedure is completed, they will print or save an electronic copy and in any case keep these general sales conditions, in compliance with the provisions of articles 3 and 4 of Legislative Decree 185/99 on distance sales.
Any right of the Customer to compensation for damages or indemnity, as well as any contractual or non-contractual liability for the non-acceptance, even partial, of an order is excluded.

Article 2: Purchase Methods

The Customer can only purchase the products present in the online catalog at the time of the order submission and viewable online at the address mascotte-costumi.com as described in the related information sheets. The order will be validly processed upon receipt in the email box communicated by the Customer of the confirmation of the authorization to charge the Customer’s credit card for the price and any transport and delivery costs, as better provided in the following art.5.
The image accompanying the descriptive sheet of a product may not be perfectly representative of its characteristics but differ in color, size, accessory products present in the figure. All purchase support information (Glossary, Purchase Guide, etc…) is to be considered as simple generic informative material, not referable to the real characteristics of a single product.
The correct receipt of the order is confirmed by mascotte-costumi.com by an email response, sent to the email address communicated by the Customer. This confirmation message will report the Date and Time of receipt of the order and a Customer order number to be used in any further communication with mascotte-costumi.com. The message reiterates all the data entered by the Customer, any information relating to the essential characteristics of the good, the indication of the price, payment methods, delivery methods and costs, and applicable taxes. The Customer must verify its correctness and promptly communicate any corrections, according to the methods described in this document.
In case of non-acceptance of the order, mascotte-costumi.com guarantees timely communication to the Customer.

Article 3: Prices

The products will be sold at the prices, including VAT, indicated in the online product sheet at the time of order confirmation by the Customer. Delivery costs may be borne by the Customer and will possibly appear on the “order summary” web page. Before the customer confirms the order by clicking on the appropriate button, the web page will display the summary of the prices of the products loaded in the cart and the delivery costs. These data will then be automatically reproduced in the order form that the customer sends to mascotte-costumi.com following the order confirmation procedures.

Article 4: Accounting Documentation and Delivery Methods

For each accepted and executed order, mascotte-costumi.com issues a fiscal receipt of the shipped material, sending it via email to the order holder, pursuant to art 14 D.P.R. 445/2000. The information provided by the Customer at the time of the order is valid for the issuance of the fiscal receipt. No variation of the fiscal document will be possible after its issuance. No responsibility can be attributed to mascotte-costumi.com in case of delay in processing the order or in the delivery of the ordered goods.

Article 5: Payment Methods

The Customer can make the payment only by Credit Card or with PayPal. At the same time as the order by the Customer, the reference bank will authorize and charge the amount related to the order made on the Customer’s credit card. In the event that the Customer exercises the right of withdrawal, in the manner defined in the following Article 6, mascotte-costumi.com will refund the amount previously charged directly to the customer’s credit card or PayPal account excluding the shipping costs already incurred.
At no time during the purchase procedure is mascotte-costumi.com able to know the information relating to the Customer’s credit card, transmitted via a secure connection directly to the site of the bank that manages the transaction and no computer archive of mascotte-costumi.com will retain such data.

Article 6: Right of Withdrawal

Pursuant to art. 5 DL 185/1999, if the Customer is a consumer (i.e., a natural person who purchases goods for purposes not related to their professional activity, or does not make the purchase indicating a VAT reference in the order form to mascotte-costumi.com), they have the right to withdraw from the purchase contract for any reason, without the need to provide explanations and without any penalty, except as indicated in the following point 6.3
To exercise this right, the Customer must send a written communication to mascotte-costumi.com in this sense, within 10 working days from the date of receipt of the goods. This communication must be sent by email to [email protected] or to the public certified email address: xxxxxxxxxxxxx
Once the aforementioned withdrawal communication has been received, the Customer Service of mascotte-costumi.com will quickly communicate to the Customer the instructions on how to return the goods, which must be received by mascotte-costumi.com within 10 days from the authorization.
The right of withdrawal is however subject to the following conditions:

  • the right applies to the product purchased in its entirety;
  • the purchased good must be intact and returned in the original packaging, complete in all its parts (including packaging and any documentation, etc…)
  • in all cases, the application of labels or adhesive tapes directly on the original packaging of the product must be avoided
  • the shipping costs related to the return of the goods are borne by the Customer
  • the shipment, until the certificate of receipt in our warehouse, is under the complete responsibility of the Customer
  • In case of damage to the goods during transport, mascotte-costumi.com will notify the Customer of the incident (within the 5th working day from receipt of the goods in its warehouses), to allow them to promptly file a complaint against the courier they chose and obtain a refund of the value of the goods (if insured); in this eventuality, the product will be made available to the Customer for its return, simultaneously canceling the withdrawal request; Mysecretcase.Com is not responsible in any way for damage or theft/loss of goods returned with uninsured shipments; upon arrival (in the warehouse), the product will be examined to assess any damage or tampering not deriving from transport. If the original packaging and/or wrapping is damaged, mascotte-costumi.com will withhold a percentage from the refund due, in any case not exceeding 10% of the same, as a contribution to the restoration costs.
  • Without prejudice to any restoration costs for damage ascertained to the original packaging, mascotte-costumi.com will refund the Customer the full amount already paid excluding shipping costs, within 14 days from the return of the goods. The refund operation will be carried out by mascotte-costumi.com through the re-crediting of the amount due, which will be paid to the credit card.
  • The right of withdrawal totally lapses, due to the lack of the essential condition of integrity of the goods (packaging and/or its content), in cases where mascotte-costumi.com ascertains:
  • the absence of the external packaging and/or the original internal packaging
  • the absence of integral elements of the product (accessories, parts, …)
  • damage to the product for reasons other than its transport
  • in the case of the lapse of the right of withdrawal, mascotte-costumi.com will return the purchased goods to the sender, charging them with the shipping costs

Article 7: Warranty and Complaints

All mascotte-costumi.com products sold by mascotte-costumi.com are covered by the manufacturer’s conventional warranty and the 24-month warranty for conformity defects, pursuant to Legislative Decree 206/05. To benefit from warranty assistance, the Customer must keep the fiscal receipt or invoice (or the DDT) that they will receive via email in PDF electronic format.
The exercise of the Warranty may involve requesting assistance from authorized service centers present in the territory and/or following the methods illustrated in the documentation present inside the product packaging.
The manufacturer’s conventional warranty is provided according to the methods illustrated in the documentation present inside the product packaging. If, following intervention by an Authorized Service Center, the defect is not covered by the manufacturer’s conventional warranty, the Customer will be charged any verification and restoration costs requested by the Authorized Assistance, as well as transport costs, if incurred by mascotte-costumi.com.
The 24-month warranty pursuant to Legislative Decree 206/05 applies to the product that presents a conformity defect, provided that the product itself is used correctly, in compliance with its intended use and what is provided in the technical documentation attached. This warranty is reserved for the private Consumer (a natural person who purchases goods for purposes not related to their professional activity, or makes the purchase without indicating a VAT reference in the order form). In case of a conformity defect, mysecretcase.com. provides, at no cost to the Customer, the restoration of the product’s conformity through repair/replacement or price reduction, up to the termination of the contract. If, following intervention by an Authorized Service Center, the defect does not result in a conformity defect pursuant to Legislative Decree 206/05, the Customer will be charged any verification and restoration costs requested by the Authorized Assistance, as well as transport costs if incurred by mascotte-costumi.com. Replacements in case of DOA (Dead On Arrival: non-functioning product upon delivery) occur only if expressly provided by the manufacturer. The replacement or possible repair times of the product depend exclusively on the manufacturer’s policies.
In the event that, for any reason, it is unable to return a product under warranty to its customer (restored or replaced), mascotte-costumi.com. may proceed at its discretion to refund the amount paid taking into account the use of the goods or to replace it with a product of equal or superior characteristics.
The repair or possible replacement times of the product depend exclusively on the manufacturer’s policies and no damage can be requested from mascotte-costumi.com for any delays in carrying out repairs or replacements.
In cases where the application of warranties requires the return of the product, the goods must be returned by the Customer in the original packaging, complete in all its parts (including packaging and any documentation and accessory equipment: manuals, cables, etc…); to limit damage to the original packaging, we recommend inserting it in a second box; in all cases, the application of labels or adhesive tapes directly on the original packaging of the product must be avoided.
The Customer will be provided with a return authorization number (RMA) which must be indicated on the outside of the package, following the instructions provided directly in the related authorization email. Any complaints must be addressed to:

Article 8: Privacy

We hereby inform you that, pursuant to and for the purposes of art. 13 of Legislative Decree 30.06.2003 n. 196, the personal data that will be provided by the Customer to mascotte-costumi.com are processed by the same, with automated methods as well, for inclusion in the customer archive and are necessary for the possible conclusion of a contractual relationship and for subsequent civil, fiscal, and managerial obligations. The data may also be used for statistical extractions and commercial and promotional communications, without prejudice to the Customer’s right to communicate at any time the desire not to receive such communications anymore.
The provision of data is optional but in its absence, it will result in the impossibility of stipulating a sales contract and therefore accepting the order.
The Customer’s data may be communicated, for the same purposes as the collection, to group companies, commercial partners, as well as to subjects to whom services are outsourced. The data controller is mascotte-costumi.com.
We inform you that, in relation to the provisions of art. 7 of the aforementioned Legislative Decree, the Customer will have, among other rights, the right to obtain:

  • confirmation of the existence of personal data concerning them
  • the cancellation, transformation into anonymous form, or blocking of data processed in violation of the law
  • the updating, rectification, or integration of data

Article 9: Applicable Law and Jurisdiction

This contract is governed by Italian Law.
For the resolution of civil and criminal disputes arising from the conclusion of this Contract, if the Customer is a consumer, the territorial jurisdiction is that of the court of reference of their Municipality of residence; in all other cases, the territorial jurisdiction is exclusively that of the headquarters of mascotte-costumi.com.
